Jonathan Garcia, former principal at the Hillside Learning and Behavioral Center in Allegan, is now serving a maximum sentence of 10 years in the Newberry Correctional Facility, but the Allegan Area Educational Service Agency is fighting a lawsuit in connection with his case involving sexual misconduct.

Allegations of criminal sexual harassment and misconduct were presented in February 2016 against Garcia by three employees of Allegan Area Educational Service Agency (AAESA), which led to his arrest and eventual conviction. AAESA confirmed that the situation involved employees only and that students were never involved. He resigned Feb. 10, 2016.

The Department of Justice recently filed a lawsuit against AAESA on behalf of the two staff members subjected to Mr. Garcia’s criminal acts. The district’s legal counsel, noting that the AAESA acted as soon as it was aware of the misconduct, is seeking to work with the Department of Justice in an attempt to resolve the complaint.

In responding to the suit, Superintendent William Brown said, “AAESA abhors unlawful and criminal acts of sexual harassment in the workplace. We are, have been, and will continue to be, proactive in training all employees with regards to sexual harassment, discrimination, and bullying. In addition, we will continue to take corrective action when informed of such violations.”

Officials confirmed that AAESA has provided regular communication, as well as training and development for staff members, in how to respond to and report harassment, abuse, and bullying. Both the web site and staff portal for AAESA provide access to the organization’s policies, as well as ways to report concerns or problems at work or school.

“We remain committed to providing an education of excellence for every student in a workplace environment that reflects civility and respect,” noted Brown. “Our commitment to continuous improvement means that we consistently follow policy and regularly review our existing procedures to ensure excellence in all that we do.
